Introduction Violence against women continues to be a highly relevant issue; indeed, approximately 6 million and 788 thousand women have experienced some form of physical or sexual violence during their lives. Often, victims turn to the Emergency Room seeking help, and in 2022 alone, 14,448 entries were recorded, mostly involving women aged between 18 and 34. Unfortunately, the number of violence cases is significantly higher than those reported because fewer and fewer women are coming forward, intimidated by the aggressor’s reaction or unaware of the various means by which they can seek help. Healthcare professionals play a crucial role in this context, particularly in their ability to identify women in danger, assist them, and guide them towards appropriate protective pathways that safeguard them comprehensively. Aim The aim of this work is to present a case report based on the analysis of an Italian news case, which will allow for the examination of the current legislation on sexual violence and assess how these tools are applied, with a focus on the nursing management of the case. Methodology This paper is a literature review. The material was selected through a search on PubMed and Google. Results The analysis clearly demonstrates that in Italy, the management of episodes of violence against women, in all its forms, still shows significant gaps both at the healthcare and legal levels. The Strasbourg Court condemns Italy for the lack of timeliness in handling incidents of violence and related complaints and highlights the need for a reform that allows for preventive rather than repressive actions. Additionally, at the healthcare level, women feel "exposed," unprotected, and particularly disoriented due to the lack of trained professionals to support and welcome them. Discussions The results highlight many shortcomings, primarily due to the lack of adequately trained personnel and a legislative system that does not act according to the modalities and timelines provided by state laws. Moreover, victims of violence are often reluctant to file complaints due to fear of the aggressor’s reaction and the judgment of family members, neighbours, and even healthcare professionals. All these leads victims not to report the violence. Conclusions This essay highlights the many gaps Italy shows in the matter of gender-based violence. It would be appropriate to introduce changes, such as an effective law reform, which would allow us to prevent such episodes, and intervene in an effective and timely manner. Also, an adequate number of specialised staff should be trained to navigate and manage those episodes of violence.
Introduzione La violenza contro le donne continua ad essere un argomento di grande attualità; infatti, si contano circa 6 milioni e 788 mila donne che hanno subito nel corso della propria vita una qualche forma di violenza fisica o sessuale. Spesso le vittime si rivolgono al Pronto Soccorso in cerca di aiuto, infatti, solo nel 2022 gli accessi registrati sono stati 14.448, riguardanti per la maggior parte donne di età compresa tra i 18 e i 34 anni. Purtroppo, però la quantità di casi di violenza è nettamente maggiore a quelli di cui siamo a conoscenza perché le donne che denunciano sono sempre meno, intimorite dalla reazione dell’aggressore o negligenti per quanto riguarda le varie modalità tramite le quali chiedere aiuto. Un ruolo molto importante, in questo ambito, spetta al professionista sanitario e alla sua capacità di identificare una donna in pericolo e di assisterla e saperla indirizzare verso un percorso appropriato che la tuteli a 360 gradi. Obiettivi L’obiettivo di questo lavoro è quello di fare un case report partendo dall’analisi di un caso di cronaca italiana, il quale mi permetterà di andare ad analizzare la normativa vigente in ambito di violenza sessuale e di vedere se e come questi strumenti vengono usati, ponendo l’attenzione sulla gestione infermieristica del caso. Metodologia L’elaborato è una revisione della letteratura. Per selezionare il materiale è stata effettuata una ricerca su PubMed e Google. Risultati Quello che si evince da questa analisi è la chiara dimostrazione che in Italia la gestione di episodi di violenza contro le donne, in ogni sua forma e genere, presenta ancora diverse lacune sia a livello assistenziale che giuridico. Quello che la Corte di Strasburgo condanna all’Italia è la mancanza di tempestività nella gestione degli episodi di violenza e delle relative denunce, e sottolinea la necessità di una riforma che permetta di agire in maniera preventiva e non repressiva. Inoltre, a livello assistenziale, le donne si sentono “scoperte”, non protette ma soprattutto spaesate a causa della mancanza di un professionista formato che le segua e le accolga. Discussione I risultati riscontrati evidenziano molte lacune e quest’ultime sono dovute principalmente alla mancanza di personale adeguatamente formato, alla presenza di un sistema legislativo che non agisce secondo le modalità e le tempistiche previste dalle Leggi dello Stato. Inoltre, le vittime di violenza sono restie dallo sporgere denuncia per paura della reazione dell’aggressore e del giudizio dei familiari, dei vicini di casa ma anche dei professionisti sanitari. Tutto questo porta le vittime a non denunciare. Conclusioni Da questo elaborato si evidenzia che l’Italia presenta molte lacune nella gestione globale della violenza di genere. Sarebbe opportuno mettere in atto due tipi di cambiamenti, ovvero: una riforma seria che permetta di agire in maniera preventiva, adeguata e tempestiva e un numero di personale sufficiente che sia formato e specializzato nella gestione degli episodi di violenza.
