This thesis explores the issue of professional liability within the field of rehabilitative healthcare professions, with particular reference to Law No. 24 of March 8, 2017, known as the Gelli-Bianco Law. The research is structured as an evolutionary analysis of Italian healthcare legislation, from the historical framework of health professions to the most recent legislative reforms, with a focus on the civil, criminal, administrative, and disciplinary implications of liability for healthcare professionals. The aim is to examine the meaning and implications of these forms of liability in light of the provisions introduced by the Gelli-Bianco reform, particularly regarding patient safety, risk management, and mandatory insurance coverage. An applied focus is dedicated to the professional autonomy of physiotherapists and to direct access to physiotherapy services, drawing on data and reflections from a report by the GIMBE Foundation. This report highlights regional disparities and evolving prospects for physiotherapists within the Italian National Health Service. To complement the analysis, an empirical survey was conducted through the administration of an anonymous questionnaire addressed to rehabilitative healthcare professionals in the Marche Region. The survey aimed to assess the level of knowledge and the practical application of the Gelli-Bianco Law. The results revealed a generally low level of legal awareness and underscored the need for stronger legal training in both academic and professional pathways to enable effective integration of the law into daily practice. In conclusion, professional liability emerges as a key element in ensuring quality, transparency, and safety in healthcare. It should be regarded not only as a legal obligation but also as a central instrument in promoting an equitable healthcare system that safeguards the rights of both patients and healthcare professionals.
La presente tesi approfondisce il tema della responsabilità professionale nell’ambito delle professioni sanitarie riabilitative, con particolare riferimento alla Legge 8 marzo 2017, n. 24, nota come Legge Gelli-Bianco. La ricerca si articola in un’analisi evolutiva delle normative sanitarie italiane, dall’inquadramento storico delle professioni sanitarie fino alle più recenti riforme legislative, con un focus sulle implicazioni civili, penali, amministrative e disciplinari della responsabilità dell’esercente le professioni sanitarie. L’obiettivo è esaminare il significato e le implicazioni della responsabilità civile, penale, amministrativa e disciplinare per gli esercenti le professioni sanitarie, alla luce delle disposizioni introdotte dalla riforma Gelli-Bianco in materia di sicurezza delle cure, gestione del rischio e obbligo assicurativo. Un focus applicativo è dedicato all’autonomia professionale del fisioterapista e all’accesso diretto alle prestazioni fisioterapiche, con riferimento a dati e riflessioni tratti da un report della Fondazione GIMBE, che mette in evidenza le disomogeneità regionali e le prospettive evolutive per il fisioterapista nel contesto del Servizio Sanitario Nazionale. A completamento dell’analisi, è stata realizzata un’indagine empirica, mediante la somministrazione di un questionario anonimo, rivolta ai professionisti sanitari dell’area riabilitativa nella Regione Marche. La survey aveva l’obiettivo di rilevare il grado di conoscenza e applicazione concreta della Legge Gelli-Bianco. I risultati emersi indicano uno scarso livello di consapevolezza normativa e la necessità di un maggiore supporto formativo giuridico nel percorso accademico e professionale per un’effettiva integrazione della legge nella pratica professionale quotidiana. In conclusione, la responsabilità professionale emerge come elemento chiave per garantire qualità, trasparenza e sicurezza nelle cure, considerata non solo come obbligo normativo, ma come strumento centrale per garantire un sistema sanitario equo, tutelando al contempo sia i diritti dei pazienti che quelli dei professionisti sanitari.
