The thesis analysed the procedures for the easements of agricultural land in the Marche region for gas pipeline construction and the determination of compensation due to the owners of the expropriated lands. The objective is to verify the gap between the provisional compensations proposed by the administration or the promoting entity and the definitive compensations obtained through the national legislation D.P.R. 327/2001-art.21. After the legal framework of predial servitudes and the examination of national and regional regulations, the work develops a comparative analysis of seven case studies from the Marche region, considering the characteristics of the lands, the areas involved, the imposed constraints, and the various components of the damage. The results highlight that, in all the examined cases, the final determination leads to compensations higher than the initial offers, with an average increase of 144.5%. This difference mainly arises from the use, in the provisional estimates, of standardised criteria and average agricultural values, which do not adequately reflect the market value, the depreciation of the residual land, the lost income, the soil damage, and the permanent agronomic limitations. An estimation simulation confirms the potential advantage of the arbitration procedure. The study emphasises the need for analytical, transparent evaluations that adhere to business specifics, capable of ensuring a fairer compensation for the involved owners.

Abstract
The study emphasises the need for analytical, transparent evaluations that adhere to business specifics, capable of ensuring a fairer compensation for the involved owners.| File | Dimensione | Formato | |
