L'azienda e il suo trasferimento.

This paper concerns the discussion of the company and its transfer into the Italian and EU legal system. In the first chapter, the notion of company is dealt with, its components and the aspects that make it up are analysed. In the second chapter, the aspect of company circulation, or part of it, is dealt with through the analysis of the transfer of the company. In conclusion, the report in its concluding chapter deals with the practical case of an illegitimate transfer carried out by the company Fastweb S.p.a. and the analysis of the reasons that led to consider this transfer illegal and irregular.

Questo elaborato riguarda la trattazione dell'azienda e del suo trasferimento nell'ordinamento giuridico italiano e comunitario. Nel primo capitolo, viene trattata la nozione di azienda, vengono analizzate le sue componenti e gli aspetti che la vanno a comporre. Nel secondo capitolo, viene trattato invece l’aspetto della circolazione dell’azienda, o di parte di essa, tramite l’analisi del trasferimento d’azienda. In conclusione, il rapporto nel suo capitolo conclusivo, tratta del caso pratico di un illegittimo trasferimento messo in atto dalla società Fastweb S.p.a. e dell'analisi delle motivazioni che hanno portato a ritenere tale trasferimento illegittimo e irregolare.
