Business crises represent a critical phase in the life cycle of companies, characterized by economic and financial imbalances that, if not managed promptly, can lead to insolvency. This thesis analyzes the phenomenon from both a theoretical and regulatory perspective, as well as through the examination of a specific case. After examining the causes and manifestations of crises, as well as the tools provided by the Italian Code of Business Crisis and Insolvency, the thesis focuses on the certified recovery plan as a tool for rebalancing and revitalization. The case study highlights how, through a realistic business plan, agreements with creditors, and the infusion of new financing, it was possible to reduce debt, preserve business continuity, and create the conditions for future development. In conclusion, the thesis demonstrates the importance of timely identification of crises and the informed use of legal instruments, confirming the value of the certified recovery plan as an effective intervention model in corporate restructuring.

La crisi d’impresa rappresenta una fase critica nel ciclo di vita delle aziende, caratterizzata da squilibri economici e finanziari che, se non gestiti tempestivamente, possono condurre all’insolvenza. La presente tesi analizza il fenomeno sia sotto il profilo teorico e normativo sia attraverso l’esame di un caso concreto. Dopo aver approfondito le cause e le manifestazioni della crisi, nonché gli strumenti previsti dal Codice della crisi d’impresa e dell’insolvenza, l’elaborato si concentra sul piano attestato di risanamento come strumento di riequilibrio e rilancio. Lo studio del caso aziendale evidenzia come, attraverso un business plan realistico, accordi con i creditori e l’apporto di nuova finanza, sia stato possibile ridurre l’indebitamento, preservare la continuità aziendale e creare le condizioni per un futuro sviluppo. Il lavoro dimostra, in conclusione, l’importanza della tempestiva emersione della crisi e dell’utilizzo consapevole degli strumenti giuridici, confermando il valore del piano attestato di risanamento quale modello di intervento efficace nel contesto delle ristrutturazioni aziendali.
