Infortuni sul lavoro e malattie professionali: la tutela INAIL

In this paper I tried to analyze the main regulations on the subject of accidents at work and professional diseases and the consequent protection guaranteed by the INAIL social security institution towards the victims of these damages. First, a historical overview was made of the main legislative stages that brought the legislation in question to today's structure; then attention was focused on the notions of accident and occupational disease and on all aspects related to these definitions, to then describe the roles in this area of the employer and employee. It was then analyzed in detail what are the main services provided by INAIL and the related requirements to access them, as well as the possibility that this public autority has to make use of the rights of subrogation and recourse. Finally, the work was concluded with a brief discussion on the health emergency caused by COVID and how the category of precarious health workers has difficulties in accessing INAIL protection.

Nel presente elaborato si è cercato di analizzare le principali normative in tema di infortuni sul lavoro e malattie professionali e la conseguente tutela garantita dall'ente previdenziale INAIL verso le vittime di questi danni. In primo luogo è stata fatta una panoramica storica delle principali tappe legislative che hanno portato la normativa in questione all'assetto odierno; poi si è focalizzata l’attenzione sulle nozioni di infortunio e malattia professionale e su tutti gli aspetti annessi a tali definizioni, per poi descrivere i ruoli in questo ambito del datore di lavoro e del dipendente. Si è poi analizzato nel dettaglio quali sono le principali prestazioni erogate dall’INAIL e gli annessi requisiti per accedervi, oltre alla possibilità che l’ente ha di avvalersi dei diritti di surroga e regresso. Infine si è concluso il lavoro con una breve discussione in merito all'emergenza sanitaria causata dal COVID e di come la categoria dei precari sanitari abbia delle difficoltà nell'accedere alla tutela INAIL.
